First Regulation on Examining and Approving Construction Land for Underground Space Released in China
The Provisional Regulation on Examining and Approving Construction Land for Urban Underground Space and Real Estate Registration of Shanghai was executed from Sept. 1, 2006, which was the first regulation concerning the examination and approval and the ownership administration of construction land for underground space in China.
The municipal government of Shanghai released this Regulation with the aim to enhance the administration of underground space construction and promote the development and utilization of underground space. According to the Regulation, the underground space of Shanghai is divided into two categories: one is the combined underground project, i.e., the underground project constructed and developed together with the ground building; the other is the separated underground project, i.e., the underground project developed individually. Moreover, the land-use and scope of underground space, the method of examining and approving the construction land for underground space, and the method of related real estate registration are also clarified in the Regulation. As to the underground construction which is approved before the release of the Regulation, its registration can be conducted through proclamation procedures.
