China Specifies the Objectives of United Urban-Rural Construction Land Market Reform
Recently, the Notice on Further Accelerating the Ownership Registration and License-Issuing for Homestead and Collective Construction Land was released jointly by the Ministry of Land and Resources, the Ministry of Finance, the Ministry of Housing and Urban-Rural Development, the Ministry of Agriculture, and the State Forestry Administration. The Notice specifies that the registration and licensing work is to, under the unified registration system of immovable property, include buildings and structures on the collective construction lands (e.g., farmhouse) into the scope of ownership registration and license-issuing for homestead and collective construction land, and to basically realize the united investigation, united ownership registration, and united licensing. This is not only an important measure to safeguard farmers’ legitimate interests and rights and to promote a harmonious and stable rural social order, but lays a property ground for further rural reform and coordinated urban-rural development. It also constitutes that the basic contents of the united registration system of immovable property are to be established. The Notice also asks to accelerate the cadastral inventory, to identify investigation methods and survey precision based on local conditions, to avoid the one-for-all practices, as well as to refine and improve relevant policies and technical standards based on actual problems of each province. It insists that illegal homestead and collective construction land should only be registered for license after it is legally approved. Local governments, therefore, should include such expenses into their financial budget to ensure its smooth progress according to No. 1 Document issued by the Central Government in 2013 and 2014.
